Financial conditions applicable to FitCONNECT subscriptions and payments
These Financial Terms complement the Terms and Conditions of Use and the Privacy Policy of FitCONNECT. They describe the financial terms applicable to subscriptions and payments made via the Platform. Their acceptance is required before any purchase or subscription. In case of any discrepancy between these Terms and the general Terms of Use, the provisions of these Financial Terms shall prevail for any matter of a financial nature.
1. Purpose of the Financial Terms
These Terms govern only the payments made to FitCONNECT for paid services offered by the Platform (Basic, Flex, and Gold subscriptions, possibly additional options). They do not cover direct payments between Users and Partners made outside the Platform, which are the sole responsibility of the relevant Partner.
2. Subscription tiers and current pricing
As of the date hereof, FitCONNECT offers three paid subscription tiers. All subscriptions are purchased for a fixed term of twelve (12) consecutive months from the date of purchase. Users who have not subscribed retain limited, free discovery access.
Basic
- Maximum reduction on Partner offers: up to 10%.
- Annual usage quotas: 5 teams and 5 activities per year.
- Family membership: not included.
Flex
- Maximum reduction on Partner offers: up to 20%.
- Annual usage quotas: 10 teams and 10 activities per year.
- Family membership: not included.
Gold
- Maximum reduction on Partner offers: 30% and more, depending on periods and Partners.
- Annual usage quotas: 20 teams and 20 activities per year.
- Family membership included: the primary User, their spouse, and their children under ten (10) years of age.
Current pricing, expressed in Tunisian Dinars (TND), is displayed in the application at the time of subscription. Any monthly price displayed is computed for indicative purposes from the annual rate (annual rate ÷ 12); actual billing remains annual. FitCONNECT reserves the right to evolve these tiers, their limits, and their prices for new subscriptions, subject to reasonable advance notice.
3. Accepted payment methods
- PayPal (bank card or PayPal account) — main solution, immediately available.
- Bank transfer — upon request and after manual validation by the FitCONNECT team (operations are recorded in an administrative-audit log).
- Any additional local payment method subsequently integrated into the Platform and expressly announced.
4. Invoicing, receipts, and accounting
For each payment made, a receipt or invoice is made available in the User's personal area or sent to the registered email address.
In accordance with the Tunisian Commercial Code, accounting documents (invoices, receipts, transaction journals) are retained for a period of ten (10) years from the end of the relevant fiscal year, including in the event of deletion of the User's account. In the latter case, accounting data is retained in a form dissociated from the erased personal identifiers.
5. Term, end of period, and refund
Term and end of period
Each subscription is purchased for a fixed term of twelve (12) consecutive months from the date of purchase. At the end of this term, the subscription automatically ends, with no automatic renewal and no further charge. The User may, if they wish, subscribe again (to the same tier or to a different tier) for a new twelve (12) month term.
Cancellation and access
The User may, at any time from the application, request to terminate their subscription. Access to the subscribed features is retained until the end of the twelve (12) month period already paid. No pro-rata refund is granted for the started period, except for any contrary mandatory provision or exceptional case assessed by FitCONNECT.
Right of withdrawal and digital services
Exceptional refund
A total or partial refund may be granted exceptionally in case of erroneous debit, double billing, serious and prolonged technical unavailability of the Service, or any other legitimate reason as assessed by FitCONNECT. Any refund request must be sent to [email protected] within sixty (60) days of the disputed debit.
6. Fraud prevention and verification
FitCONNECT implements automatic and manual controls intended to prevent and detect any suspicious operation (abusive chargeback, card fraud, money laundering, quota circumvention, transactions presenting anomalies). These controls notably include:
- reconciliation of payments with notifications from the payment provider (PayPal webhooks);
- verification of the account holder's identity in case of anomaly;
- temporary or permanent suspension of transactions presenting a risk;
- cooperation with competent Tunisian authorities in case of suspected offense.
The User undertakes to cooperate in good faith with FitCONNECT during any reasonably necessary verification and to provide, where applicable, the requested supporting documents.
7. Financial commitments of the Partner
When the Partner receives, directly or indirectly via the Platform, sums from Users or from FitCONNECT (commission, payout):
- the Partner is solely liable for all tax, social, and reporting obligations arising therefrom in Tunisia (VAT, corporate income tax, social contributions, declarations to the CNSS where applicable);
- FitCONNECT pays the amounts due, where applicable, after deduction of its platform commission and according to the conditions agreed between FitCONNECT and the Partner;
- FitCONNECT is in no case responsible for the contractual, employment, or tax relationships that the Partner has with its own clients, employees, or contributors.
8. Limitation of financial liability
Without prejudice to the mandatory provisions of Article 12 of the Terms of Use, the financial liability of FitCONNECT to a User, all causes combined, is limited to the amount of payments actually received by FitCONNECT from that User during the twelve (12) months preceding the triggering event.
Any dispute relating to a payment, a debit, an invoice, or a refund must be notified in writing to FitCONNECT ([email protected]) within a maximum period of sixty (60) days from the date of the debit or the disputed event, failing which the right is forfeited.
